Important Notice: Alcoholic beverages cannot be sold to persons under the age of 18 by law. Any customer who orders alcoholic beverages online must guarantee that he or she is 18 years of age or older and has the legal right to purchase the above products. Customers must ensure that any unqualified person does not use the customer's web login account to purchase alcoholic beverages. If the delivery includes alcoholic beverages, a person aged 18 or above (with appropriate proof) must receive the goods. If the above person is not present, the company has the right to take back the goods and will try to deliver them at another agreed time.
Online Shopping Terms and Conditions
1. General Terms
1.1. In these Online Shopping Terms and Conditions and K Group Wine e-Store Special Terms (as defined below) (collectively, the "Terms and Conditions"), "K Group Wine" or "we" or "us" refers to K Group Wine business under K Group Store Limited, and "Customer" or "you" refers to any individual, organization or company who orders goods or services from us. Please read these Terms and Conditions carefully before using this website or our application (collectively, the "e-Store"). By using the e-Store or any part thereof, you agree that you have read these Terms and Conditions and accept and agree to be bound by them.
1.2. We will make every effort to ensure that the prices, information and sizes of the products listed on the e-shop are up to date. We reserve the right to change the prices of the products without prior notice. All orders are subject to our sole discretion and are subject to stock availability.
1.3. We will make every effort to ensure that the products listed on the e-store are available in stock. If any product is unavailable to customers due to out of stock, we have the right to offer a product of the same type and price as an alternative.
1.4. All orders are subject to final confirmation, subject to the availability of the relevant goods. If we are unable to provide any ordered products or services, we have the right to refuse to accept the order.
2. User Registration
2.1. You must register as our user (online or otherwise) before you can order goods or services in the e-shop. When registering, you promise that:
• Provide true, accurate, current and complete information about yourself as requested;
• Only you or someone authorized by you may log into the e-store using your username and password;
• We have the absolute discretion to reject any new user application and terminate any registered user without providing any reason.
2.2. If there are any changes to your registered information, you can log in to your account to update or notify K Group Wine Service immediately by phone or email to ensure that we can bring you the latest information.
2.3. If your account has not been used for a certain period of time (currently 3 years), we will deem your account no longer in use and will make it invalid for your and our protection. All points and/or e-vouchers in your account will also be cancelled (if applicable). If you wish to shop at the e-store again, you must apply for a new account.
3. Privacy protection
In order to protect your privacy rights in respect of your personal data, we ensure that our policies and practices in respect of the collection, use, retention, transfer and access of personal data comply with the provisions of the Personal Data (Privacy) Ordinance (Chapter 486) of the Laws of Hong Kong. Please refer to our Privacy Policy and Terms .
4. Payment Methods
4.1. The e-store accepts payment by credit card, debit card or other designated electronic payment methods specified by us. The value of all goods is calculated in Hong Kong dollars. The prices of goods in the e-store may differ from those in our physical stores. The prices of goods are subject to the prices shown in the e-store on the day of ordering.
4.2. All goods ordered online are subject to our sole discretion and are subject to stock availability. You will receive a final purchase receipt for record keeping when you receive the goods (upon delivery or in-store pickup).
5. Others
5.1. Basis of supply: We sell and deliver products only to end consumers. We do not sell our products for resale. If we have reasonable grounds to believe that you are not purchasing our products for your own use, we have the right to refuse or cancel your order.
5.2. Force Majeure: If we are unable to accurately provide the products or services you require due to force majeure (including natural disasters, fire, flood, accidents, riots, war, government policies, embargoes, strikes, labor difficulties, equipment failure or any circumstances beyond our control), we will not be liable to the user or any third party.
5.3. You may not assign, transfer or otherwise transfer any of your rights and obligations under these Terms and Conditions to any other person without our prior written consent.
5.4. If any provision of these Terms and Conditions is deemed to be illegal or invalid, such provision will be deleted and will not affect the legality, validity and enforceability of the remaining provisions of these Terms and Conditions.
5.5. These Terms and Conditions contain the entire agreement between the parties and supersede all prior negotiations, representations, understandings and agreements.
5.6. We have the right to amend, modify or supplement all or any of the terms and conditions at any time by notifying you in advance.
5.7. In the event of any dispute, we reserve the right to make the final decision. The Chinese translation of these Terms and Conditions is for reference only. In the event of any discrepancy between the Chinese and English versions, the English original shall prevail.
5.8. These Terms and Conditions will be interpreted in accordance with the laws of the Hong Kong Special Administrative Region of the People's Republic of China, and both you and us are subject to the jurisdiction of the Hong Kong courts. We may amend and modify these Terms and Conditions from time to time without prior notice to you.
K Group Wine Special Terms ("Special Terms")
These Special Terms are in addition to the above Online Shopping Terms and Conditions and apply to your orders from the e-shop. In the event of any discrepancy, the K Group Wine e-shop Special Terms shall prevail.
6. K Group Wine’s Payment Terms
6.1. We accept payment by Visa, MasterCard, American Express and UnionPay.
6.2. The maximum purchase amount per transaction is:
• Visa / MasterCard: HKD50,000
• American Express: HKD 50,000
• UnionPay card: HKD 50,000
Note: When entering your credit card number, do not enter spaces or dashes.
6.3. The e-store uses designated credit card purchase protection services (such as Visa Verification Service and MasterCard Secure Code Service) to allow you to shop online with peace of mind and security when using Visa and MasterCard cards. The service uses a specific personal password or security code to ensure that you are the only person authorized to use the card. You should use a valid credit card in your own name for online shopping.
6.4. If there are additional delivery charges, these will be confirmed separately before you make payment.
7. Ordering Information
7.1. The e-store only accepts orders to a designated billing address for delivery in Hong Kong, or for self-collection at a designated physical store in Hong Kong.
7.2. When you place an order with us, you agree to make a purchase request to us in accordance with these Terms and Conditions. Once we have received your order, we will notify you and confirm receipt of the order. This response does not mean that we have accepted your order. We have the right to refuse to accept an order if we are unable to provide any of the ordered products or services, or due to payment problems with the credit card you used or for any other reason. If we are unable to provide any of the products or services on your order, we will notify you by phone or email.
7.3. Once your order request is accepted by us, we will confirm your order acceptance and inform you of the time and date for delivery/pickup at the designated physical store.
8. Delivery service (applicable to orders delivered to a specified delivery address)
8.1. For every purchase of 6 bottles or HK$1,800 or more at the e-store , you can enjoy free delivery service (details are included in the invoice). For purchases of less than 6 bottles or HK$1,800 , a delivery service fee of HK$80 will be charged.
8.2. Delivery service is limited to fixed addresses, including Hong Kong Island, Kowloon, New Territories, Tung Chung, Discovery Bay and Ma Wan. Please pay attention to the delivery service method for details (please click here for details )
8.3. Next Day Delivery Service
• Once you have successfully placed your order in the e-store before 5pm from Monday to Saturday (except public holidays), your order has been accepted and payment has been completed, and you have received email confirmation, we will deliver the goods to your designated delivery address within 1-4 working days.
• Online orders received after 5pm on Saturdays, Sundays and public holidays will be delivered on the second business day after the holiday.
• Please note that all deliveries will be made as scheduled to the best of our ability.
• This service may be affected due to seasonal factors (such as during major sales events) or festivals (such as Christmas, Chinese New Year or Easter).
8.4. Delivery service is not applicable to:
• Non-fixed address, restricted area, outlying islands, hotel room, dock or warehouse;
• If the number of items purchased is 5 or more and the delivery address is not accessible by lift and is on the 4th floor or above; and
• The delivery address does not have a legal unloading area within 50 meters of the building.
8.5. After you submit an order in the e-store, if the order is accepted by us, we will confirm with you the estimated delivery time and date. When the goods arrive, please check whether the ordered goods are complete, and the recipient will write his name and sign on the delivery note to confirm receipt of the goods.
8.6. If Typhoon Signal No. 8 or Black Rainstorm Warning is hoisted, we will endeavour to arrange delivery on the next working day.
8.7. If you fail to collect your ordered products due to no showing at the first agreed delivery appointment or because you provided an inaccurate address, we reserve the right to (i) charge you additional delivery costs for subsequent delivery appointments or (ii) arrange for you to collect the products directly from our store.
8.8. All delivery dates and times are estimated delivery dates and times. K Group Wine will not be liable for any loss or damage you may suffer as a result of any delay in delivery.
8.9. If you are unable to collect the goods within two weeks of the order confirmation date due to no fault of ours, we reserve the right to charge you for storage fees based on our prevailing service fees. In such event, you must pay the relevant storage fees before you can collect the goods.
8.10. In case of any disputes, we reserve the right to make the final decision.
Store Pickup Service (applicable to orders that have chosen to be collected at a designated physical store)
9.1. When the products you ordered are ready for collection, we will notify you by email and you can go to the store to collect the products during business hours on the day you specify.
9.2. Please collect the purchased products at the physical store and date selected in the e-store within [3] days during business hours. Otherwise, we reserve the right to transfer the goods to our warehouse for storage and charge storage fees according to our current service fees. In this case, you must pay the relevant storage fees before you can collect the goods.
9.3. When you collect the product in the store, you or your authorized representative must show us the email confirming your order for identity verification. We may need you to provide further information to verify your identity (such as your full name or other personal information under your account). If we cannot confirm that the person requesting to collect the goods is you or your authorized representative, we will refuse to allow that person to collect your order to protect your interests.
9.4. If the store where you choose to collect the product is closed due to weather or other factors, you can go to the store to collect the product the next day.
10. Exchanges and Refunds
10.1. After the consignee confirms receipt of the goods, any glassware or wineware, foreign wine or champagne with a value of HK$700 or above or aged more than 10 years (calculated per bottle) will not be refunded under any circumstances.
10.2. If we agree that you are entitled to exchange a product, but the product you request to exchange is no longer available, we will refund the relevant amount to you.
10.3. At our sole discretion and under special circumstances, we will refund the amount of online purchases to your credit card bank account (it takes about 4-6 weeks).
10.4. Please show us proof of purchase before accepting a product exchange.
10.6. Goods must be returned together with any free gifts included with the purchase, otherwise we will deduct the value of the free gifts from the refund.
11. Others
11.1. We will retain ownership of the relevant products until the customer has paid the full amount of the purchase price, and the relevant risks will be deemed to have passed to the customer when the relevant products are delivered to the customer.
11.2 If the customer has specific requirements for the product version , please check with us first to confirm before placing an order . Otherwise, it will be deemed that you have tacitly agreed to the version and we will reserve the right to make the final decision .
11.3. In accordance with the Product Eco-responsibility Ordinance, we have implemented a full plastic shopping bag charge since 1 April 2015. If customers request any K Group Wine shopping bag to be included in the delivery, a charge of HK$2 will be charged for each plastic shopping bag.
11.4. We have the right to destroy any goods that have not been received more than one month after the order confirmation notification date or the relevant storage fees have not been paid more than one month after the order confirmation notification date without further notice. In this case, we will not refund or compensate you; we reserve the right to continue to charge you for storage fees.
11.5. We will not be liable for any loss of income (whether direct or indirect), profit or any indirect or consequential loss arising from your dealings with us under any circumstances.
